This is, in reality, something that poses a difficulty for many students of knowledge today. They say: We know that Islam only permitted enslavement as a penalty for their disbelief, their stubbornness, and their standing in the way of the call to Allah and His religion. So their penalty in this world was to be enslaved and made slaves. They say this is reasonable. But what about this one who was enslaved and yet believed in Allah and His Messenger, like the one about whom the Messenger (peace and blessings be upon him) said:
For I saw him praying فإني رأيته يصلي
. The answer to this is that many of the captives who fell into the hands of the Muslim army would embrace Islam when they mingled with the Muslims, lived among them, and saw up close and in detail the effect of Islam in the upbringing of Muslims and in their moral character with good morals. From this life, which they were forced to live with their masters, they became clear about what they had not known before regarding the extent of Islam's effect on its adherents in their upbringing and in improving their behavior. So when they saw this beneficial effect of the Islamic religion on its followers, their hearts would open to this Islam, and they would embrace Islam and begin to pray. He was a disbeliever before, and he did not become a captive except because he was a disbeliever. But after he was captured and enslaved, and the goodness of Islam as a religion for all mankind became clear to him, this slave embraced Islam. So why should he remain an enslaved slave? The answer is: If Islam had established a system whereby a captive, as soon as he falls into captivity and declares his Islam, becomes free, this would have been a source of harm to the Muslim army. Because every time a captive fell into the hands of a Muslim, he would say: I bear witness that there is no god but Allah and that Muhammad is the Messenger of Allah. And assuming the system required his manumission, they would say to him: Go, be on your way. What would that amount to? He would return to his country and prepare again, he and his companions who had not been captured, or who had been captured and released. Therefore, the interest of the Muslim army requires that the disbelieving captive remain a captive even if he declares his Islam, for fear that this declaration is a means for him to escape captivity, and that his Islam was not out of conviction and faith. Therefore, this reality existed in the lives of Muslims regarding their captives. The enslaved captive was a disbeliever, then he embraced Islam, and he remained a captive, enslaved, and a slave. At the same time, the Wise Lawgiver did not block the path of freedom for this enslaved slave after his Islam. He did not block the way for him to get rid of his captivity. Rather, He commanded the Muslim masters who had such slaves who had embraced Islam after their enslavement. Allah (Mighty and Majestic) commanded their masters to write a contract of manumission with them, and He said: "So write a contract of manumission with them if you find in them good." The contract of manumission is a contract of manumission by the master for his slave; it means a contract and agreement made between the master and his slave that if he presents to him a certain amount of dirhams, then as soon as he presents the final installment of these dirhams, he becomes free, despite the master, based on this agreement which the Wise Lawgiver commanded and made obligatory upon the masters. That is, it is not permissible for the Muslim master to keep his slave enslaved after his Islam if he sees good in him. Rather, he must open the way for him to be freed from slavery and enslavement by buying his freedom with money and presenting it to the master. At that point, it is obligatory upon the master to manumit him.
