The Shaykh : If one says "martyr" based on our opinion, there is nothing wrong with it, but being certain is not permissible. Some hadiths narrated by 'Abd Allah ibn Lahiyah, traced back to the Prophet (peace and blessings be upon him), state:
There is a slain man between the two ranks whose intention is known only to Allah. رب قتيل بين الصفين الله أعلم بنيته
