The Time of the First Release

Machine translationRead the Arabic original
Does the first release occur by stoning the Aqabah pillar alone?
This is a point of disagreement among the scholars. Some scholars say: If he stones it, the first release occurs for him.

And some of them say: It does not occur except by shaving or cutting the hair.
This is a matter of research and consideration for us.And if someone were to say: Why do we not act according to the most cautious approach? So we say: The release does not occur except by both: stoning and shaving. We said: Yes, this is more cautious in the sense that the person stays away from the prohibited things, but sometimes the most cautious approach may be to consider him released by the stoning. For example: If a person had intercourse with his wife after the stoning and before the shaving,If we said: If it is said that he is not released except by shaving, then this intercourse would be before the first release, and it would necessitate the invalidity of his ritual, continuing in it, making it up, and sacrificing a camel. And if we say: If he is released by the stoning, his ritual is not invalidated and he does not have to sacrifice a camel; rather, he only has to pay a fidyah (ransom payment).

The reality is that caution is a problem if you exercise caution and say: If it is said that he is not released except after the stoning and shaving, we say: This is good as a precaution. But the second scenario came to us: If a person has intercourse after the stoning and before the shaving, how do we deal with him?If we say: If it is said that he is not released except by shaving, then it follows that his Hajj is invalid and that he must make it up and sacrifice a camel. And if we say: If it is said that the first release has occurred, then his Hajj is valid and he only has to pay a fidyah (ransom payment).
