The Ruling on Marriage with the Intention of Divorce, Especially Abroad
Machine translationRead the Arabic original
Your Eminence! One of the brothers posed a question to your Eminence in the one hundred and fifty-first session,He said in it: Is it permissible to marry with the intention of divorce? And your answer was: that it is not permissible; because in that there is deception and fraud toward the wife and her family. However, one may marry with a definite intention, and if he returns to his country or finds her unsuitable for him, the matter is broad in that regard. But we see that some people now arrange a trip from their country for tourism and go abroad,And he says: that he will marry with a definite intention, and remain there for two or three weeks and marry, but it appears that it is the opposite of that,By the evidence: that he did not prepare himself to receive his wife in his country, and did not seek permission from the one in authority regarding his marriage to this foreign woman, and did not investigate the legal eligibility of this girl, and did not inform his family of his desire to marry in that regard. So what is your guidance for such people, and do you have a detailed answer? May Allah reward you with good.
Yes,May Allah bless you! I say: The Prophet (peace and blessings be upon him) mentioned for us a just and fair measure: (Actions are only by intentions, and every person will have only what he intended) So if this man’s going to the other country is only to enjoy this marriage, then this is unlawful sexual intercourse, there is no doubt in it; because he went to commit unlawful sexual intercourse and return.
And as for if he truly wants to see what is in this universe of Allah’s (Mighty and Majestic) creations and the natures of people, especially if he is a man with taste in these matters, and then he marries there with the intention that it is a definite marriage, then there is nothing wrong with it.
And it has reached me, unfortunately: That some of the youth now who are not on a good and upright path go to other countries to marry with the intention of divorce,And this, as I told you first: this is unlawful sexual intercourse, there is no doubt in it,And we should, even if we say: regarding the permissibility of a traveling stranger marrying with the intention of divorce, if we were to say it, we should not issue a general fatwa on it in order to prevent this danger, which is that one travels in order to marry. And the scholars (may Allah have mercy on them) who narrated the disagreement in this issue said: If this is assumed for a stranger who traveled for other than this; for other than marriage, either for trade, or seeking knowledge, or something similar,They said: then if bachelorhood becomes difficult for him, there is nothing wrong with him marrying with the intention of divorce.
