A man divorced his wife for the first time with a revocable divorce and did not take her back until the period for taking her back ended. He says: Does she return to me now with a new contract, or is it sufficient to have witnesses?Note: If it were with a new contract, they might take advantage of me and the taking back would become difficult?
Once the waiting period is completed, she becomes forbidden to the husband, and the husband becomes like any other man. He proposes to her anew and contracts with her anew, and he pays the mahr that the two parties agree upon, and this is necessary.Allah the Exalted said:
And when they have [nearly] fulfilled their term, either retain them according to acceptable terms or part with them according to acceptable termsفَإِذَا بَلَغْنَ أَجَلَهُنَّ فَأَمْسِكُوهُنَّ بِمَعْرُوفٍ أَوْ فَارِقُوهُنَّ بِمَعْرُوفٍ
[Al-Talaq: 2] .
