The Shaykh : The fourth topic: Many people today play with the dissolution of the marriage contract in its dissolution, not in its formation. You find a man getting angry at his wife over the slightest thing, the slightest thing makes him angry at her, and then he pronounces the divorce. If he comes in and the teacup hasn't even been finished, he gets upset and shouts at the woman, saying: "You are divorced, you are divorced, you are divorced," and he does not care. We ask Allah for well-being. If he says that and it is from the inspiration of Satan, it falls into his hands and he regrets it. He makes rounds among the scholars hoping to find a way out, and it is said to him: "There is no way out for you, because if you had feared Allah, He would have made a way out for you, but you did not fear Allah."

Second: If the husband wants to divorce her, he should not divorce her while she is menstruating. Because if the woman is menstruating, the soul may be repelled by her and not be attached to her, and he is in that state not desiring her. So he is prohibited from divorcing her until she becomes pure, so that he may reconsider himself.

If he divorces her in a state of purity in which he had intercourse with her, and then her pregnancy becomes apparent, this may be the last divorce pronouncement, and he will regret it, and the child will be lost to him. Perhaps the child will be in the custody of someone far from him. Therefore, it is not permissible for a man to divorce his wife in a state of purity in which he had intercourse with her. When, then, should he divorce her? He should divorce her in two cases: The first case: That she is pregnant. If he divorces his wife while she is pregnant, the divorce takes effect, contrary to what some laypeople think: that a pregnant woman cannot be divorced. This is a mistake, because Allah said in Surat al-Talaq:
O Prophet, when you [Muslims] divorce women يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ
[At-Talaq 65:1]
until He said:
And for those who are pregnant, their term is until they give birth وَأُولاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[At-Talaq 65:4]
So the divorce of a pregnant woman takes effect. It may be the last divorce pronouncement, but that does not matter, because he knew the child and knew that she was pregnant, so he has the right to divorce her even if he had intercourse with her an hour before. The second case in which divorce is permissible: That he divorces her.
