The Shaykh : Finally, I say that what is obligatory in the udhiyah is not obligatory in the 'aqiqah, regarding some of the conditions. For example, it is required that the udhiyah be free from blindness; it must not be blind, nor must it be emaciated, meaning it has no marrow in its bones, which is an indication of emaciation. Furthermore, what is required in the udhiyah is not required in the 'aqiqah, namely that one must combine three things in the udhiyah: eating from it on the day of 'Id, storing some of it, and giving some of it in charity. These are three things. The Prophet (peace and blessings be upon him) initially forbade his Companions (may Allah be pleased with them) from storing the udhiyah, and he said: After that prohibition, the Messenger (peace and blessings be upon him) lifted this ruling by the command of his Lord, naturally, as a concession for the Ummah. He commanded them to do three things: to eat on the day of 'Id to bring joy to themselves and their families, to store some so that they would remember Allah's blessing upon them, and not to forget the right of the poor in their udhiyah. These are three things that Allah made obligatory through the tongue of the Messenger in the udhiyah. However, these are not obligatory in the 'aqiqah: neither the conditions of the udhiyah as we mentioned, nor these three commands. So what does the one who slaughters for his child do? He has complete choice; he does whatever he wishes with it. Because when the Prophet (peace and blessings be upon him) legislated the 'aqiqah and commanded certain things and remained silent about others, his silence regarding a matter was out of mercy. Therefore, the one who slaughters for his child has the choice to do whatever he wants with the 'aqiqah. He may eat it all, he and his family, with pleasure and contentment. He may give it in charity if he is wealthy and spends most of his days eating fresh meat due to his wealth. He may combine these, eating and giving in charity. He may also invite whomever he wishes of his brothers, and he undoubtedly has the reward of inviting his Muslim brothers to a meal, based on his saying (peace and blessings be upon him): So, from the perspective of "the best of you is the one who feeds people," he may feed his brothers from this 'aqiqah. And I see, and this is an opinion open to discussion because it does not stem from the Book of Allah or the hadith of the Messenger of Allah (peace and blessings be upon him), but rather it is an opinion based on the principle of "unrestricted public interest" (al-masalih al-mursalah). The principle of unrestricted public interest is a very great principle, and from it I proceed to say: since this Sunnah has been abandoned by people for many long years, as I indicated at the beginning of this speech, I propose to everyone whom Allah (Glorified and Exalted is He) has blessed with a child that he perform the 'aqiqah first, as an obligation as we mentioned, and observe all the rulings previously explained. In addition to that, he should invite some of his brothers to clarify to people what most people have nearly forgotten about this Sunnah, so that it spreads. Thus, the one who revives this Sunnah by calling people to it will have the reward of it and the reward of everyone who acts upon it until the Day of Resurrection, without any diminishment of their rewards. This is what I felt inclined to speak about on this pleasant occasion. We hope that Allah (Blessed and Exalted is He) will reward our brother Abu Usamah, who invited us to this noble and blessed call, with the best reward. And we hope that he has entered into the generality of his saying (peace and blessings be upon him):
I used to forbid you from storing the meat of the sacrificial animals, but now store it, eat it, and give it in charity.
كنت نهيتكم عن إدخار الأضاحي ألا فادخروا وكلوا وتصدقواThe best of you is the one who feeds people, spreads the greeting of peace, and prays at night while people are sleeping.
خيركم من أطعم الطعام وأفشى السلام وصل في الليل والناس نيامWhoever introduces a good practice in Islam will have the reward of it and the reward of everyone who acts upon it until the Day of Resurrection, without any diminishment of their rewards.
