Al-Halabi : The questioner asks a question, and it is perhaps the last one. He says: A man had his house robbed in a land of disbelievers, in America, and this house is insured, meaning he receives money in exchange for this theft. But the company asked him to provide a list of the stolen items so that they would give him their value or compensation. He wanted to add to this list, so instead of saying he had, for example, one washing machine, he would say two, or something similar, increasing and doubling the amount. This company became suspicious or wanted to verify, so they asked some people, and perhaps some of his brothers, his siblings, were among them. These siblings are committed to their religion, whereas he is not committed. So they ask: Is it permissible for us to testify to this falsehood, let alone the ruling on the original insurance and the like? May Allah reward you with good.

The Shaykh : Of course, it is not permissible for the insured person to increase the estimate, let alone is it permissible for his brothers to testify to this false increase. This is based on his saying (peace and blessings be upon him):
I cannot be witness to an injustice إنّي لا أشهد على جور
Sahih Muslim 1623f
As for insurance in its original form, it is gambling. This is a calamity that has spread throughout the lands, so insurance is not permissible in any case. And perhaps among the consequences of this forbidden insurance is that it leads to such deception and some people testifying to lies and falsehood.

The questioner : My brother says that all of them are Jews who take our money. My non-committed brother only prays. He says all this money goes to the Jews.

The Shaykh : If the Jews are consuming people's money by falsehood, should we imitate them and consume people's money by falsehood? And if he is testifying to this testimony, why does he live with them? Why does he associate with them and live in their lands? Zakariyya and those like him who are committed should adhere to the saying of the noble Messenger (peace and blessings be upon him):
I cannot be witness to an injustice إنّي لا أشهد على جور
