Q: Islam is built upon four schools of jurisprudence, and the people of Najran do not say "Ameen" when the imam finishes reciting al-Fatihah in the prayer; they claim that they follow the Hanafi school, and that the Mukrami among them does not pray in congregation without permission from their leader, Ali al-Mukrami ?
A: First: The religion in the sight of Allah is Islam, and its rulings are based on the Book of Allah and the Sunnah of His Messenger (peace and blessings be upon him), and the evidence derived from them. As for the imams of the four famous schools of jurisprudence and other Muslim scholars who engage in independent legal reasoning, they take rulings from these evidences to the extent of the knowledge and understanding of the religion that Allah has granted them. From each of them, what is correct in his statements is accepted, and what is erroneous in his rulings is rejected. The Book and the Sunnah, along with the sound evidence that refers back to them, are what decide this and distinguish error from truth. Second: The Messenger of Allah (peace and blessings be upon him) legislated saying "Ameen" after the recitation of al-Fatihah in
the prayer by his words and his actions. This is in what al-Bukhari and Muslim narrated from Abu Hurayrah that the Messenger of Allah (peace and blessings be upon him) said:Sunan Abi Dawud 936Sahih (Al-Albani), and in what Abu Dawud and al-Tirmidhi narrated from Wa'il ibn Hujr (may Allah be pleased with him), . The majority of scholars acted upon this, including the Hanafis, except that the Hanafis do not say "Ameen" audibly. The hadith is a proof against them regarding saying it audibly in the prayers where recitation is audible. Third: Performing the five obligatory prayers in congregation is obligatory according to the correct opinion of the scholars, and their performance in congregation does not depend on the permission of any human being, neither Ali al-Mukrami nor anyone else. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
