The Shaykh : This action is not valid, but it is obligatory for him to return it to the state, not to the responsible party, because returning it to the responsible party may lead to difficult consequences. How does he return it to the state? He returns it to the Bayt al-Mal, because the Bayt al-Mal is part of the state treasury, and in that case, he will have cleared his conscience, if Allah wills.
