The questioner : A group of travelers combined Maghrib and 'Isha' by delaying the prayer. During the prayer, one of them joined the congregation forgetting the combination and intending 'Isha'. During the prayer, he remembered that his companions were praying Maghrib, so he changed his intention from 'Isha' to Maghrib. What is the ruling on this prayer?

The Shaykh : This prayer is not valid, neither for Maghrib nor for 'Isha'. As for Maghrib, it is because he invalidated it and turned away from it to the intention of 'Isha. As for 'Isha, it is because he did not begin it from the start of the prayer, for the beginning of the prayer was for Maghrib. Accordingly, this brother must pray the Maghrib prayer and must pray the 'Isha' prayer. If he is traveling, he makes up the prayer with two rak'ahs, because two rak'ahs became obligatory upon him, so he makes it up with two rak'ahs, based on the saying of the Prophet (peace and blessings be upon him):
Whoever sleeps through a prayer or forgets it, let him pray it when he remembers it. من نام عن صلاة أو نسيها فليصلها إذا ذكرها
His saying:
Let him pray it فليصلها
means he prays that prayer in its characteristic form. For this reason, the scholars said: "Making up a prayer mirrors its performance". So whoever makes up a travel prayer while resident prays two rak'ahs, and whoever makes up a resident prayer while traveling prays four, and whoever makes up a night prayer during the day recites aloud, and whoever makes up a day prayer at night does not recite aloud, because the consideration is for the makeup, i.e., the prayer being made up.
