What is the ruling on the one who abandons prayer?

The questioner : Regarding the one who abandons prayer, may Allah reward you with good: Now, of course, many of the scholars, some of them say that he is a disbeliever, and some of them say: he is an open sinner. So what is his ruling in this issue, and is it disbelief that does not take one out of the religion, or is it disbelief that takes one out of the religion?

The Shaykh : We mentioned this issue in *Silsilat al-Ahadith al-Sahihah* (The Chain of Authentic Hadiths), and we stated that whoever abandons prayer intentionally, deliberately, and denying its obligation is a disbeliever by the consensus of the Ummah. However, if he abandons it out of laziness while acknowledging its obligation and hoping that Allah the Exalted will guide him and enable him to pray, then he is not a disbeliever in a way that constitutes apostasy and takes him out of the religion. This is because the disbelief that takes its owner out of the religion is established in the heart. So if this one who abandons prayer is a believer in his heart, acknowledging what Allah has made obligatory upon him of obligations, but he acknowledges that Satan, the soul that commands evil, trade, and so on—there is no doubt that this excuse is rejected against him—however, it serves as a mitigating factor so that he is not declared a disbeliever as long as he believes in what Allah, Blessed and Exalted is He, has legislated. The verified scholars, such as Ibn Taymiyyah, Ibn al-Qayyim al-Jawziyyah, and others, have established a general rule, which is distinguishing between practical disbelief and creedal disbelief. So whoever falls into creedal disbelief is the one who apostatizes from the religion. As for whoever falls into practical disbelief, he is not ruled to have apostatized, but rather to be an open sinner and a transgressor. Thus, the one who abandons prayer is not ruled to be a disbeliever unless he denies it with denial. In that case, he becomes a disbeliever. Therefore, the school of the majority of scholars is not to declare the one who abandons prayer a disbeliever except with denial. This is a narration from Imam Ahmad himself, and the majority of the Imams agreed with him that if the abandonment is not due to denial, it is open sinfulness and not disbelief.

The Prophet (ﷺ) had not sat till he had entered the house and said to me, "Where do you like me to pray in your house?" I pointed at a place in my house whereupon he stood and said, "Allahu Akbar." We lined behind him and he prayed two rak`at and finished it with Taslim. We then requested him to stay for a special meal of Khazira which we had prepared. A large number of men from the adjoining area gathered in the house. One of them said, "Where is Malik bin Ad-Dukhshun?" Another man said, "He is a hypocrite and does not love Allah and His Apostle." The Prophet said, "Do not say so. Do you not think that he has said: "None has the right to be worshipped but Allah," seeking Allah's pleasure? The man said, "Allah and His Apostle know better, but we have always seen him mixing with hypocrites and giving them advice." The Prophet (ﷺ) said, "Allah has forbidden the (Hell) Fire for those who testify that none has the right to be worshipped but Allah, seeking Allah's pleasure. " من قال لا إله إلا الله نفعته يومًا من دهره

Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He wills إِنَّ اللَّهَ لَا يَغْفِرُ أَنْ يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ
[An-Nisa 4:48]
. So abandoning prayer is an act that exposes its owner to dying—may Allah protect us—from faith. And abandoning prayer is among the characteristics of the disbelievers who do not pray, do not give zakah, and do not pray. So if a Muslim does not pray, he resembles the disbelievers, and his disbelief here is practical disbelief. And there are many, very many hadiths that must be interpreted, for example, he (peace and blessings be upon him) said in the Farewell Pilgrimage, and he delivered a sermon to them and ordered Jarir ibn 'Abdullah al-Bajali to make the people listen, so he (peace and blessings be upon him) said:
Do not return to unbelief after me by striking the necks of one another. لا ترجعوا بعدى كفارًا يضرب بعضكم رقاب بعض
Sahih Muslim 65
... And his (peace and blessings be upon him) saying:
Abusing a Muslim is an outrage and fighting against him is unbelief سباب المسلم فسوق وقتاله كفر

. So if a Muslim kills a Muslim or fights him—may Allah have mercy on you—does he apostatize from his religion? The answer is: No; because Allah said:
And if two parties among the believers fight, then make reconciliation between them. But if one of them transgresses against the other, then fight the one that transgresses until it returns to the command of Allah وإن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما فإن بغت إحداهما على الأخرى فقاتلوا التي تبغي حتى تفيء إلى أمر الله

. So He considered both parties—the rebellious one and the one against whom rebellion is committed—to be among the believers, even though the Messenger (peace and blessings be upon him) says in the previous hadith:

. So how do they interpret the disbelief? Disbelief that does not take one out of the religion, practical disbelief, and so on. Likewise, the hadiths of prayer that explicitly state that whoever abandons prayer has disbelieved: either it is said that he is on the verge of creedal disbelief, on the verge of dying on other than the religion of Islam, or that he disbelieved practical disbelief. This interpretation is necessary so that we do not strike the hadiths of the Messenger (peace and blessings be upon him) against each other. Yes.
