Is it permissible to appoint an emir for a group on a single methodology that holds circles for study and education?

Machine translationRead the Arabic original
The questioner : Regarding this brother's question

The Shaykh : Yes.

The questioner : I say: This group establishes schools for itself, and for example, it sets specific lessons, directives, and sermons in some mosques. Do they not have the right to have an emir whom they obey in implementing these programs, such as setting a schedule in the schools where so-and-so is given the subject of hadith, so-and-so is given the subject of fiqh, and so-and-so is given the subject of tafsir? May Allah reward you. Does the emir not have the right to be obeyed in these matters?

The Shaykh : My answer to this, may Allah reward you, is: If a company were established in a worldly matter, would the company stand without a president who is obeyed? This is more deserving of that than this. But the problem is that it is not permissible for us to give this president what the Lawgiver gave to the greatest caliph.

The questioner: No, no, no

The questioner : The obligation of obedience. They say that this emir must be obeyed, and if you do not obey him, you sin. May Allah reward you. In a matter that is recommended, the command he gives me might be recommended, or it might be permissible. So, for example...

The Shaykh : This is what we fear, and this is what you referred to earlier, on the condition that the rulings of the greatest emir are not given to this emir. And now you have brought up an example: If the Muslim caliph commands the Muslims to do something that is recommended to leave, they are obligated to obey. But here, no, it is not so, is it?

The questioner : We want this, O Shaykh.

The Shaykh : And I have given it to you.

The questioner : May Allah benefit you through you, because they, O Shaykh, even in what is permissible, even in what is recommended, they make obedience obligatory.

The Shaykh : And I have given it to you. This is their contradiction of the Shari'ah, and their bringing forth rulings for which Allah has not sent down any authority, and the cause is their use of analogical reasoning.

The questioner : O Shaykh, I want clarification, may Allah reward you. Frankly, there is a young man you find who is never assigned any work; he wants absolute freedom, so that no one tells him to do anything.

The Shaykh : Yes, that is correct.

The questioner : That is, one person does good and establishes an institution, and builds schools, and wants them to study, and they say to him: You have no obedience at all. That is, we put these programs in place, we only want safety, someone acts and makes a mistake, and this must happen in the da'wah of Islam. And this may exceed the obedience he deserves to the obedience of the caliph. So, the best thing is to provide answers for them—may Allah reward you—that reconcile and harmonize the two sides. This is not for him; he may follow the path of the unruly. This is not for him; he may follow the path of the tyrants. Let us cooperate; this is cooperation in righteousness and piety. We conduct teaching, we conduct da'wah within these limits, at the level of brotherhood and love, and we carry out obedience to Allah and conveying the call of Allah.

The Shaykh : You have spoken well. Yes.
