The questioner : In the Arab countries, the honorable Shaykh says, if I wear the abaya, I am considered an oddity, and likewise when I cover my face with a covering veil, I hear words and mockery that hurt me greatly. Is it permissible for me to place the abaya on my shoulder rather than on my head? And is it permissible for me to wear the niqab given the situation I described?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment. There is no doubt that wearing the abaya on the head is more concealing and further from fitnah (trial, discord or temptation). If that is the case, it is better for the woman to do so. Wearing the abaya on the shoulder while covering the rest of the body is permissible, but remaining as she was before is better, unless the society she is in is one where women wear the abaya on the shoulder, in which case there is no harm.
As for the niqab, there is no doubt that it is permissible in the Shari'ah (Islamic sacred law), because it was used in the time of the Prophet (peace and blessings be upon him). However, if we were to issue a fatwa (a scholarly legal ruling) permitting it today, women would expand its use, as is the reality. The woman would not limit herself to what is permissible in the niqab, which is an opening only as large as what allows the woman to see her path. Rather, she would expand it and make a wide opening that includes the eye, the eyelid, part of the forehead, and part of the brow. The woman would also not limit herself to revealing the eye without enhancing it with kohl or the like. Therefore, we do not issue a fatwa permitting it, even though we believe it is permissible. We do not issue a fatwa permitting it to protect the woman from expanding in that and revealing what is not permissible to reveal. Yes.
