Resuming the discussion on the issue of making up the witr prayer.

The questioner : I say, we have proceeded in this issue...

The Shaykh : You have done well, listen to the answer. Making up (qada') in the Shari'ah is, and the linguistic meaning is naturally not the meaning of performing the act of worship outside its time. This meaning is technical, not Shari'ah-based or linguistic. The linguistic meaning is bringing the act of worship to completion, as the Exalted said:
And when the prayer has been concluded, disperse within the land فإذا قضيت الصلاة فانتشروا في الأرض
[Al-Jumu'ah 62:10]
. Does any Arab, or even any non-Arab like me, understand "I made up the prayer" to mean "I performed it outside its time"? Of course not. So, if you make up the prayer, it means you completed it, then disperse. Likewise, His saying, the Exalted:
And when you have completed your rites, remember Allah like your [previous] remembrance of your fathers or with [much] greater remembrance. فإذا قضيتم مناسككم فاذكروا الله كذكركم آباءكم أو أشد ذكرا
[Al-Baqarah 2:200]
This is exactly the same. You have finished making up the rites of Hajj, not as it was said, "Hajj, and the people are returning," "Hajj, and the people are returning," the people are returning from Hajj while he is going to perform Hajj as a make-up. No. So, when you have made up your rites, it means in the prescribed time. And likewise his saying, peace and blessings be upon him:
When you come to the prayer, come to it with calmness and composure, and do not come to it in haste. Whatever you catch up with, pray, and whatever you miss, complete. إذا أتيتم الصلاة فأتوها وعليكم السكينة والوقار ولا تأتوها وأنتم تسّعون فما أدركتم فصلوا وما فاتكم فأتموا
And in a narration:
And make up what you missed وما فاتكم فاقضوا
And because of this second narration, and due to the poor understanding of the non-Arab jurists who followed my Hanafi school, they differed with the majority of jurists regarding the one who joins the prayer late by one rak'ah or more, who has entered the prayer and missed a rak'ah, whether when he stands to perform this rak'ah, it is the completion of the prayer...
