If a company purchases goods from another company but delays payment, it is fined at a rate of twenty percent. Is this riba, what is the way out of it, and what is the ruling on working in

Machine translationRead the Arabic original
The Shaykh : The matter you mentioned, my brother, my brother Husayn, is that if one delays beyond the agreed period, they impose a fine on him. The answer was that he should not delay and should pay in cash or within the specified period. What does the ship have to do with the matter?

The questioner : Oh, our Shaykh.

The Shaykh : Yes.

The questioner : I mean, we, the sellers, currently have companies that take from us every month, and they try to delay paying the money at the specified time. Then we have a period of one month during which they pay from the date of shipment, meaning the goods go to their countries and they pay within one month from the date of shipment. In the case of their delay in payment, the company has an agreement with them based on twenty percent for every day of delay.

The Shaykh : From the buyer, my brother?

The questioner : The buyers are foreign companies; we are the sellers.
The Shaykh: You are the sellers.

The questioner : Yes.
The Shaykh: Who takes the fine?
The questioner: We take it.
The Shaykh: Ah.
The questioner: We take it; the selling company takes the fine.
The Shaykh: So you, who say "we are the sellers," mean you are the company?
The questioner: Yes, an oil company.
The Shaykh: And you are a member of the company?
The questioner: I am an employee of the company.

The Shaykh : Well, why do you take this fine?

The questioner : I mean, if a customer delays, if we do not do this...

The Shaykh : Ah

The questioner : The settlement is not completed until after a year or two, sometimes. It is as if the previous practice in the work was that the customer does not pay at the specified time and delays payment, and so on. But when there is a delay fine of twenty percent, he pays the money at the specified time.

The Shaykh : Well, what is the difference between this transaction and riba?

The questioner : That is my question, my Shaykh.

The Shaykh : This is riba, my brother, if the company does not suffer harm due to the delay, and the harm is only the delay in delivering the money. That is riba itself.

The questioner : The company's argument is that the money could be invested elsewhere.

The Shaykh : That is the argument of the usurers.

The questioner : Yes.

The Shaykh : Yes, exactly.

The questioner : What is the way out of this, my Shaykh?

The Shaykh : By Allah, I do not see a way out as long as it is a company, and today there is no company that stands on the rulings of the Shari'ah.

The questioner : This is what exists.

The Shaykh : And this is the example you are looking into now; this is a non-Islamic transaction.

The questioner : There is no doubt in this, I mean.

The Shaykh : Well, so I do not know what the way out is. The way out is that you should fear Allah and be moderate in your request.

The questioner : The problem, my Shaykh, is that the law requires...

The Shaykh : And do not cooperate in sin and aggression.

The questioner : Well, can I work in the same administration on the condition that I do not perform this specific operation?

The Shaykh : You are appointed for it, whatever your work is.

The questioner : The ordinary matters that do not involve riba... anyone...

The Shaykh : These ordinary things, in their worst case, are like the janitor who collects the trash in the bank. Does the bank function without its cleaning? Did you hear me?

The questioner : Yes.

The Shaykh : Did you understand me?

The questioner : Yes, O our Shaykh.

The Shaykh : So this janitor is a partner with all those who work in this bank, and so is the example you are asking about.

The questioner : What is the ruling for an employee if the company he works for invests their money in riba?

The Shaykh : It is the same; in the Syrian expression, "he is the worst of them."

The questioner : Well, the problem, my Shaykh, is that every state is based on this foundation... so the judges, or the imams of the mosques, or the employees, or the advisors.

The Shaykh : Now you have mixed the good with the bad. Is the one who leads people in prayer in the mosque like the one who works in the company?

The questioner : I did not mention that, my Shaykh. I meant the source of the money is the same.

The Shaykh : The source of the money is not what concerns us, and our research is not about the source of the money. May Allah forgive you. If a usurer came and bought from the baker, is that baker like that employee in the company? They are not equal, for example. So you should not look into the source of the money while you are looking into the employee who is appointed by the company that performs what is contrary to the Shari'ah.

The questioner : Well, my Shaykh, if the main work of the company is selling oil, for example?

The Shaykh : My brother, may Allah guide you, stay in your place, you are in your turn and in your turn, and you do not come with anything new. A company is either based on the rulings of the Shari'ah or on their violation. It is not permissible for a person to be a member of this company or work in it if it is not based on the rulings of the Shari'ah. And it is not the case for all employees in the state. First, one looks at the nature of the job. A teacher who teaches students Islamic education, as they say today, and takes his salary from the state, and another teacher who teaches students music, are they equal, for example?

The questioner : No

The Shaykh : So, then, judge accordingly.

The questioner : Good, if Allah wills. Yes.

The Shaykh : Good, you see.

The questioner : Yes.

The Shaykh : I pray for your good, so I say, good, you see.

The questioner : May Allah reward you with good, O Shaykh.

The Shaykh : And you as well.

The questioner : When will we see you soon, if Allah wills, in our country?

The Shaykh : If Allah wills.

The questioner : Well, my Shaykh, may Allah reward you with good.

The Shaykh : And you as well.

The questioner : Peace be upon you and Allah's mercy.
[Another call]

The Shaykh : And upon you be peace, and the mercy of Allah and His blessings.

The Shaykh : You have become like the one who hit me and cried, and preceded me and complained. He is...Abu Layla : He called you to ask you, and you went back to ask.

The questioner : I am the one who called on the phone; I am the one who requested the number.

The Shaykh : You requested the number?

The questioner : Yes.

The Shaykh : And we requested you.

The questioner : Glory be to Allah.

The Shaykh : Yes, we met. This is a sign of good.

The questioner : Welcome, my Shaykh. How are you?

The Shaykh : Praise be to Allah, I am well

The questioner : My Shaykh, a man is in prayer.
