The questioner : The questioner says, honorableThe Shaykh : He says: I committed zina with a woman, and that woman became pregnant, then I married her and the contract was concluded for me while she was approximately seven months pregnant. After her delivery, I brought the marriage officer and he concluded the contract for me again while she was in a state of purity, but without the presence of the wali and without his knowledge. Then, after Allah granted me guidance, one of the brothers advised me to conclude a new contract, so I did so, but without a Shari'ah marriage officer. I appointed her wali to her marriage, and the wali concluded the contract for me by saying, "I give you in marriage so-and-so," and I accepted that, but without witnesses. I ask for clarification, knowing that I have five children from her, and she is now four months pregnant?

The Shaykh : I say that narrating the question in this manner is contrary to decency. That is, for a man to say, "I committed zina, I did this, and I did that," is contrary to decency. When a person is covered by Allah, he should cover himself with Allah's cover. However, if he had said, "What do you say about a man who committed zina with a woman, she became pregnant from him, and then he married her?" that would have been less severe. But to make this public declaration, I will discipline him by not answering his question. You know that discipline means correction, and correction is either by beating, which I have no means of doing, or by imposing a fine, which I also have no means of doing, or by reprimanding him in front of people, or by depriving him of what he deserves. As 'Umar ibn al-Khattab (may Allah be pleased with him) disciplined those who divorced their wives with three divorces at once by preventing them from taking them back, saying, "There is no taking back, and the divorce takes effect as three." Therefore, the important point is that, given this questioner's poor expression, I am disciplining him by not answering this question. However, I say that it is obligatory for him to return to the court to rectify his situation. Yes.
