Q: If the husband recites the sermon of need and asks for the woman’s hand from her guardian in the presence of witnesses, without there being a marriage officer to conduct the contract for him, is this contract permissible without a marriage officer or not?
A: If the matter is as described, with the offer coming from the father and the acceptance from the husband in the presence of the two witnesses, then the marriage is valid. As for the husband taking on the recitation of the sermon of need, this does not prevent the marriage from being established. However, it is prescribed to announce the marriage and not conceal it, due to the command of the Prophet (peace and blessings be upon him) to do so, and his command to beat the hand drum for it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
