The questioner : May Allah reward you. A questioner says: I have, or a questioner says: I have gold for adornment that I do not use except once a year. Is its zakah on me, knowing that I am not employed or working, or is its zakah on my husband as part of his maintenance obligations?

The Shaykh : Yes, the zakah on a woman's jewelry is on the woman herself, based on the saying of Allah the Exalted:
And those within whose wealth is a known right والذين في أموالهم حق معلوم
[Al-Ma'arij 70:24]
and the saying of the Prophet (peace and blessings be upon him) to Mu'adh ibn Jabal when he sent him to Yemen:
then teach them that Allah has made it obligatory for them to pay the Zakat from their property أعلمهم أن الله افترض عليهم صدقة في أموالهم

. The jewelry belongs to whom? To the woman, so its zakah is on her. But if her husband volunteers to pay her zakah and she agrees to that, there is no blame on him. He would be praiseworthy for doing so, because this woman mentioned that she is not employed, not a teacher, and has no income coming to her. She would be required to sell some of her jewelry if she does not have what she needs to pay the zakah. This may affect her husband's treatment of her. But if he volunteers, and is praiseworthy for it, by paying the zakah on her behalf, he is doing good. And the Prophet (peace and blessings be upon him) said:
The best of you is the one who is best to his wife, and I am the best of you to my wives. خيركم خيركم لأهله وأنا خيركم لأهلي

. As for the amount of zakah, it is one-quarter of one-tenth, like the zakah on ordinary gold. In other words, the woman estimates, she estimates her jewelry as used jewelry, not as new jewelry.
