How does one who has taken a house as a *subrah* act, and why is it called a *subrah*?

Machine translationRead the Arabic original
The questioner : How does one who has taken our house as a *subrah* act? And why is it called a *subrah*?

The Shaykh : The *subrah* is derived from *sabr*, which means detention.

The questioner : Yes.

The Shaykh : This is because the land or house subject to a *subrah* is detained with the one who holds the *subrah*.

The questioner : Yes.

The Shaykh : The holder of the *subrah* is, in the custom of people, like the owner in his disposal of the property subject to the *subrah*. You will find that he plows, plants, digs wells for water, and if it is residential land, he builds on it, rents it out, and disposes of it as the owner does, as long as the *subrah* remains. This is unlike the tenant; the tenant does not have the right to dispose of the house or land he has rented except in accordance with the terms of the lease contract. Yes.

The questioner : May Allah bless you.
