The Ruling on Selling with a Deposit?

Machine translationRead the Arabic original
The questioner : The deposit that the buyer gives to the seller on the condition that he will bring the rest of the amount tomorrow, or the seller says, "Did you buy it?" He says, "Yes." The seller says, "Give me a deposit," so he takes five thousand riyals, or a thousand, or more or less. Then he leaves and does not come, and the item is sold after that. Is the deposit that was taken returned to the seller?

The Shaykh : The correct ruling on selling with a deposit is that it is permissible, and that the seller owns it. For example, you might say, "I bought this car from you for fifty thousand, and the deposit is these five thousand. If the sale is completed, it is the first part of the price; if the sale is not completed, it belongs to the seller." Although this involves a condition on the sale, it does not harm because it is in the interest of both parties. For this reason, it was reported from 'Umar (may Allah be pleased with him) that this sale is valid, and it is in the interest of everyone. The interest of the seller is apparent, because he will receive money and his goods are with him. We only permitted him this, even though he did not pay a consideration for it, because the value of the goods will decrease if it is known that they were bought and people lose interest in them. As for the buyer, his interest is that he is saved from paying the entire price.

The questioner : Your Eminence, may Allah guide you and protect you: There are those who wash the dead and bury them who mention certain things, such as: when they wanted to wash one person, his body turned black, or when they put him in the grave, he turned toward the qiblah. They asked about him, and it turned out that he did not pray, or something like that. It has been reported from you that these things are neither affirmed nor denied. I do not know about the correctness of this statement?

The Shaykh : This is correct. We say that we do not affirm these things, but we do not deny them, because Allah the Exalted may manifest punishment in this world for the sake of admonition and lesson. For this reason, the two graves were revealed to the Prophet (peace and blessings be upon him) in which they were being punished, and he said:
They are being punished but they are not being punished for anything major. إنهما ليعذبان وما يعذبان في كبير
Sunan Ibn Majah 349Sahih (Darussalam)
As for exaggerating in this, such as saying, "When we buried him, we found him turned away from the qiblah," this requires a sound chain of narration. Smoking is not greater than other sins. Yes, that is all.
