A question regarding the ruling on a child in the state of ihram who is carried by his father while he performs tawaf, with the child’s right side facing the Ka'bah.

Machine translationRead the Arabic original
The Shaykh : But the problem is, if he carries him on his shoulder, will the child’s right side be facing the Ka'bah or not?

The questioner : Evidence...

The Shaykh : Facing the Ka'bah.

The questioner : How, O Shaykh?

The Shaykh : If he holds him like this on his shoulder, the child’s right side faces the Ka'bah, and the child also walks backward. So what is your opinion on this issue? Do we say that the consideration is for the carrier and the carried, where the carried is like a tool that does not move or walk? Yes. Or is the consideration for the carried and the carrier?

The questioner : ...

The Shaykh : Huh?
The student: ... and there is no consideration for the fact that he is...
Another student: ... the Companions during the Farewell Pilgrimage, there was...

The Shaykh : Many people.
The student: Is there a proof for this?

The Shaykh : Fine, and is this during his arrival in Makkah or during his return?
The student: No, I mean.

The Shaykh : We do not ask.
The student: For the call to Islam.

The Shaykh : Yes, that is right.
The student: Shaykh, may Allah reward you, either he carries him on his shoulders as you mentioned and decided just now, which is a hardship for the father, or he carries him like women do, in a cloth behind him.

The Shaykh : There is no problem with carrying... there is no problem, because his left side is the carrier’s left side and is in front. Likewise, if he places him on the same shoulder and leaves his face facing the same direction as the carrier’s face, there is no problem. But many people squeeze him tightly, as they say, so that the child’s chest is against the father’s chest. Yes.
The student: The consideration is for the carrier.

The Shaykh : Yes, the consideration is for the carrier. Why?
The student: Because it means it is difficult for him if he does not carry the child.

The Shaykh : Yes, sound?
The student: Allah, Glorified and Exalted is He, has excused the Ummah of Muhammad (peace and blessings be upon him) from the inability to do so, and this... he acts on his own... and he is not able to straighten it... and the principle is that the Shari'ah requires a person to act according to what is easiest for him.

The Shaykh : The important point is, are you saying it is sufficient due to hardship?
The student: Yes, we did.

The Shaykh : Yes, very well.
The student: The intention is that of the carrier, O Shaykh, because the small child originally does not have an intention; his father or his carrier is the one who intends on his behalf.

The Shaykh : I mean, are you saying you say it is sufficient, but you two differ on the cause? One of you says the cause is hardship, and Allah says:
has not placed upon you in the religion any difficulty ما جعل عليكم في الدين من حرج
[Al-Hajj 22:78]
.
The student: This is added to it.

The Shaykh : Two causes, I mean, fine.
The student: Shaykh, is it not said that the small child is not of discernment, so his intention is not sufficient?

The Shaykh : No, we are not talking about the intention now. The intention is known; the details are in it.
The student: He intends for himself first.

The Shaykh : A small child cannot, and you know the crowding.
The student: His father performs tawaf for himself first, then for the small child.

The Shaykh : It is not a problem, may Allah reward you, regarding the intention. The problem is that if he performs tawaf with him a second time after he has performed tawaf for himself, he wants to carry him like this. The important thing is that what appears to me is that it is sufficient. First: because of the hardship you mentioned. Second: because the carried person is now like a tool, meaning he has no movement of his own; he is not the one walking. Therefore, if we considered the carried person, the carried person would now be walking backward. And if a person performs tawaf around the Ka'bah walking backward, it is sufficient.
The student: No, it is not sufficient.

The Shaykh : It is not sufficient, even if he places the House on his left side, it is not sufficient, because if he places the House on his left side, he will be facing the opposite direction, yes.
