The questioner : Your Eminence, a man entered the state of ihram with his young son, and during the tawaf he carried him while circumambulating. Does that tawaf count for both himself and his son, given that the child is wearing a diaper containing impurity?

The Shaykh : Yes, the stronger opinion in this matter is that if a person carries another person and performs tawaf with him, and the one being carried is of an age to understand intention, then the tawaf counts for both the carrier and the one being carried. This is because the one being carried in this situation is no more than a rider on the carrier, and the intention comes from the one who intended to perform tawaf. However, if the one being carried is not of an age to understand intention, then the tawaf is not valid for the one being carried, only for the carrier. The one being carried must be carried around again. So, if this boy is of discernment and his guardian tells him, "This is tawaf," and he intends it, then there is no harm in carrying him. But if he is not of discernment, it is not possible for one tawaf to have two intentions, one for the carrier and the other for the one being carried. This is the strongest of the opinions in our view in this matter, although some scholars say it counts for everyone, and some say it does not count for everyone. Yes.

The questioner : Now, regarding the diaper.

The Shaykh : As for the diaper, if there is impurity in it, the rule of the jurists (may Allah have mercy on them) is that the tawaf of the one carrying it is not valid because he is carrying impurity. However, the correct view is that the tawaf is valid and that it does not harm him that there is impurity in the diaper of this young boy being carried.
