The questioner : How do we determine whether the prohibitions of the Prophet (peace and blessings be upon him) are prohibitions of prohibition or prohibitions of dislike?

The Shaykh : This is also a point of disagreement among the scholars of usul al-fiqh (the principles of jurisprudence) regarding whether a prohibition implies prohibition (tahrim) or dislike (karahah). Some hold that it implies prohibition, while others hold that it implies dislike. Some have distinguished between the two, stating that if the prohibition relates to acts of worship, it implies prohibition, but if it relates to manners, it implies dislike. In reality, there is no comprehensive rule covering every prohibition reported from the Prophet (peace and blessings be upon him and his family), because you will encounter prohibitions that scholars have interpreted as implying dislike, and others that they have interpreted as implying prohibition. Therefore, one must examine each specific prohibition to see whether it necessitates prohibition according to the rules of the Shari'ah, or whether it necessitates dislike according to the rules of the Shari'ah.
In summary, we say that the scholars have three opinions regarding the implication of a prohibition. The first opinion is that it implies prohibition absolutely. Accordingly, anyone who interprets a prohibition as not implying prohibition must be asked for evidence.
The second opinion is that it implies dislike absolutely. Accordingly, anyone who interprets a prohibition as implying prohibition must be asked for evidence.
The third opinion is to distinguish between them. If the prohibition relates to manners and morals, it implies dislike. If it relates to acts of worship, it implies prohibition. Yes.

The questioner : May Allah bless you.
