The Book of the Prayer of the Traveler and Its Shortening-05a

Machine translationRead the Arabic original
The reciter: And Muhammad ibn al-Muthanna narrated to us, saying: Ibn Abi 'Adi narrated to us, saying: Hisham narrated to us from Yahya from Abu Usamah, saying:
Abu Salama asked 'A'isha about the prayer of the Messenger of Allah (ﷺ) She said: He observed thirteen rak'ahs (in the night prayer). He observed eight rak'ahs and would then observe Witr and then observe two rak'ahs sitting, and when he wanted to bow he stood up and then bowed down, and then observed two rak'ahs in between the Adhan and lqama of the dawn prayer.
Sahih Muslim 738b
.

The Shaykh : The apparent meaning of this hadith is that the Prophet (peace and blessings be upon him) used to pray the two rak'ahs after performing the witr. This appears to contradict his statement (peace and blessings be upon him):
Make the last of your prayer at night witr. اجعلوا ءاخر صلاتكم في الليل وترا
It was said that this falls under the category of the conflict between speech and action, and when speech and action conflict, the action is given precedence.
The student: The speech.

The Shaykh : The speech, due to the possibility of a specific circumstance regarding the action. The condition is that these two rak'ahs do not conflict with the fact that the last of his prayer is the witr, and that these two rak'ahs are in the position of the rawatib for the obligatory prayer. This is evidenced by the fact that the Prophet (peace and blessings be upon him) gave them a rank lower than the rank of the witr, where he prayed them.
The student: Sitting.

The Shaykh : Sitting, while the witr he prayed standing. Ibn al-Qayyim (may Allah have mercy on him) leans toward this view. Some of the scholars said that he does this once and that once, and the majority is that he does not pray anything after the witr. Thus, this is among the incidental matters, and incidental matters do not invalidate the general rules. Yes.
