Chapter: The eating of the one in dire necessity. By His saying, the Exalted: “O you who believe! Eat of the good things We have provided for you and be grateful to Allah if it is Him you worship. Only the dead, blood, the flesh of swine, and that which is dedicated to other than Allah is forbidden to you. But whoever is compelled by hunger, not intending to transgress or exceed the limit, there is no sin upon him.”

The reciter: Chapter: The eating of the one in dire necessity. By His saying, the Exalted: [Al-Baqarah 2:172-173] And He said: [Al-Ma'idah 5:3] And His saying: [Al-An'am 6:118-119] And His saying, Exalted and Majestic is He: [Al-An'am 6:145]. And Ibn Abbas said [regarding the word] “poured out.” And He said: [An-Nahl 16:114-115].
The Shaykh : The author (may Allah have mercy on him) did not mention a hadith in this chapter, and perhaps he did not find a hadith meeting his conditions, but he mentioned verses indicating that the one in dire necessity may eat whatever he needs. The one in dire necessity is the one whom necessity has befallen and who is forced by necessity to eat. If a person is forced to eat carrion, it becomes lawful for him. Does he eat until he is full? We say, no, he does not eat until he is full, because necessity must be measured by its extent. Is he allowed to carry some with him? Yes, he is allowed to carry some, because carrying is not eating. If he needs it, he eats it, and if he is free of the need, he discards it and leaves it.

(173) He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah. يا أيها الذين آمنوا كلوا من طيبات ما رزقناكم واشكروا لله إن كنتم إياه تعبدون إنما حرم عليكم الميتة والدم ولحم الخنزير وما أهل به لغير الله فمن اضطر باغ ولا عاد فلا إثم عليهBut whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful.
فمن اضطر في مخمصة غير متجانف لإثم فإن الله غفور رحيم(118) So eat of that [meat] upon which the name of Allah has been mentioned, if you are believers in His verses. (119) And why should you not eat of that upon which the name of Allah has been mentioned while He has explained in detail to you what He has forbidden you, excepting that to which you are compelled. And indeed do many lead [others] astray through their [own] inclinations without knowledge. Indeed, your Lord - He is most knowing of the transgressors.
فكلوا مما ذكر اسم الله عليه إن كنتم بآياته مؤمنين وما لكم أن لا تأكلوا مما ذكر اسم الله عليه وقد فصل لكم ما حرم عليكم إلا ما اضطررتم إليه وإن كثيرا ليضلون بأهوائهم بغير علم إن ربك هو أعلم بالمعتدينSay, "I do not find within that which was revealed to me [anything] forbidden to one who would eat it unless it be a dead animal or blood spilled out or the flesh of swine - for indeed, it is impure - or it be [that slaughtered in] disobedience, dedicated to other than Allah. But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], then indeed, your Lord is Forgiving and Merciful."
قل لا أجد فيما أوحي إلي محرما على طاعم يطعمه إلا أن يكون ميتة أو دما مسفوحا أو لحم خنزير فإنه رجس أو فسقا أهل لغير الله به فمن اضطر غير باغ ولا عاد فإن ربك غفور رحيم(114) Then eat of what Allah has provided for you [which is] lawful and good. And be grateful for the favor of Allah, if it is [indeed] Him that you worship.
