The questioner : The seller who makes a mistake in the calculation may give the customer more or less without intent; does he pay the loss and take the excess? We ask for guidance on this matter.

The Shaykh : Yes, it is obligatory for the seller, if he learns that the buyer gave him more than what was due, to return it to him if he knows him. If the buyer has died, he returns it to his heirs. If he does not know him and has despaired of his return, he gives it in charity on his behalf.
As for when it becomes clear that the buyer gave him less than what was due, he may search for this buyer and demand the missing amount. However, whether the buyer accepts or not is a matter that is referred to the court.
