The questioner : Is it permissible to kill the dogs that ruin the crops and urinate in the water channel that flows to the water reservoir when it rains, given that we have water reservoirs for drinking from rainwater and we have no other source, and that the dogs sit in the water channels? Please advise us, may Allah reward you?
The Shaykh : It is permissible to kill harmful dogs. This is because animals are of two types: one whose nature is to cause harm, and if it is peaceful, that is merely an incidental trait. The one whose nature is to cause harm, a person is commanded to kill it, as in the authentic hadithSunan an-Nasa'i 2881Sahih (Darussalam).

The Shaykh : It is prescribed to kill these because their nature is to cause harm. Even if it were assumed that some of them are peaceful due to an incidental factor, that does not prevent the recommendation to kill them. Another category of animals does not cause harm by nature, but harm occurs from them incidentally, such as dogs that cause harm incidentally by eating crops, tearing open houses, and the like. It is permissible to kill these.

The Shaykh : Because harm has actually occurred from them, and they resemble the biting dog that the Prophet (peace and blessings be upon him) commanded to be killed. If these dogs cause harm to this extent, they are encroaching on your property, and it is permissible to kill them.
