and a woman must not ask to have her sister divorced in order to deprive her of what belongs to her, but she must marry, because she will have what Allah has decreed for her. ولا تسأل المرأة طلاق أختها لتكفيء صحفتها ولتنكح فإنما لها ما كتب الله لها
Sahih Muslim 1408g
This means a woman who was proposed to said to the suitor, “There is no problem, on the condition that you divorce your wife.” This is forbidden for her because it is an act of aggression. The husband is not obligated to fulfill this condition. But if he does not fulfill this condition, does the married woman who stipulated this condition have the right to annul the marriage? There is a detail in this: if she knew that it was forbidden, she has no right to annul it, because she knew that it was an invalid condition that could not be fulfilled. If she did not know, she has the right to annul it, because in that case she would be ignorant and unaware. If someone asks, “And if she stipulated that he not marry another woman, is that valid?” The answer is yes, it is valid for her to stipulate that he not marry another woman. The difference between this condition and the condition that the wife be divorced is that in the latter, the right of the first wife is realized, and in the condition of her divorce, there is aggression against her. As for the first issue, if she stipulated that he not marry another woman, no one’s right is attached to this husband, and if he agrees not to marry another, he is bound by what was stipulated for him.
