The questioner : He also says: If a Muslim opposes the rest of the congregation regarding combining prayers due to rain and cold, because he does not consider combining permissible due to the absence of intention before the prayer, which is more preferable: praying with the congregation or separating from it?

The Shaykh : First, it has been established that the correct view is that intention is not a condition for combining prayers.

The questioner : Yes.

The Shaykh : And that it is permissible for a person to combine if the cause is present, even if it occurs during the first prayer.

The questioner : Yes.

The Shaykh : As for opposition, if a person opposes out of taqlid (following a scholar without knowing his evidence) or ijtihad (independent legal reasoning), he is not held accountable for the opposition itself, if this is the extent of his fear of Allah the Mighty and Majestic.

The questioner : Yes.

The Shaykh : Otherwise, it is obligatory for the Muslim, once the truth becomes clear to him, to follow it, whether that agrees with what he believed yesterday or contradicts it.

The questioner : Yes.

The Shaykh : Because the believer’s faith is not complete until his desire follows what the Prophet (peace and blessings be upon him) brought.

The questioner : Yes.

The Shaykh : So if this Muslim opposes them while believing that his opposition is correct and that it is the religion of Allah by which he will face his Lord on the Day of Resurrection, then he has what he believed, and no one is compelled to accept the ijtihad of another if clear, evident proof has not been established for its correctness.

The questioner : Yes.

The Shaykh : Based on this, we say to this opponent: There is no blame on you if you do not combine while you believe that combining is not valid.

The questioner : Yes.

The Shaykh : But we see that it is more preferable that you pray with the congregation with the intention of a voluntary prayer.

The questioner : Yes.

The Shaykh : Because deviating from the congregation of Muslims is something that should not be done, even though the Messenger (peace and blessings be upon him) ordered the one who prayed in his home, performed the obligatory prayer, and then found a congregation, to pray with them.

The questioner : Yes.

The Shaykh : And he said that it would be a voluntary prayer. So what we see is that he prays with them and intends it as a voluntary prayer, and when the time for 'Isha' (the night prayer) enters, he prays 'Isha'.

The questioner : Yes.

The Shaykh : Yes.
