The questioner : His second question states that all the people of our tribe collect the zakah and give it to the jurist, saying that whoever fasts must give it to the jurist, and that it is the zakah of the body. Are they right?

The Shaykh : The jurist or the poor person?

The questioner : No, the jurist... the judge of the town.

The Shaykh : Yes.

The questioner : Give us your ruling, may Allah reward you.

The Shaykh : If this jurist is trustworthy and gives it to the poor who are entitled to it, then there is nothing wrong with people giving their zakah to him. However, the payment should be made one or two days before the festival, and he should deliver it to the poor before the festival prayer. But if the jurist takes it for himself on the pretext that he is a jurist, while he is wealthy and does not need it, then it is not permissible to give it to him, and it is also not lawful for him to take it if he is not among those entitled to it.

The questioner : Yes.

The Shaykh : Yes.
