Q2: We live in a desert region where we raise sheep and grow corn, millet, sesame, and other grains, relying on rain. When the year turns, we pay the zakah on the sheep and give it to the shaykh of the tribe, who eats it. We also give him the zakah on the grains, and we fear that we are committing sins by giving it to the shaykh. We know that the zakah collector comes every year, but she arrives after the year has passed. Please clarify for us what is required of us in performing the zakah; is it valid to give it to the shaykh or not? Please inform us, may Allah reward you.
A2: Zakah is obligatory on grazing sheep when they reach the nisab, and it is also obligatory on stored grains and fruits when they reach five awsuq. One must give one-tenth if they are watered by rain. It is not permissible to give it to the shaykh; rather,
it must be given to the zakah collector, even if she arrives late, or to the poor and needy if the collector does not come. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
