The questioner : Also, from Saleh in Khamis Mushait, another question asks whether selling sheep on credit with a fifty percent increase in value is valid and lawful? I hope for an answer on the radio. May Allah guide you.

The Shaykh : On credit, if he means deferring the payment.

The questioner : Yes.

The Shaykh : That is, selling them with deferred payment at a fifty percent increase. There is no harm in that, as long as the buyer is a sane adult who manages his affairs well. It is permissible to sell to him with deferred payment at a fifty percent increase, or more, or less. However, the term must be known, such as saying, "I bought this sheep from you for a period of one year, or two years, or something similar." If the buyer is poor and the seller knows he is poor, and he says, "I bought it from you until I am able to pay," meaning until Allah makes me wealthy, there is no harm in that. This is because it is the requirement of the contract. If the buyer is poor, it is not permissible for the seller to demand the price until Allah makes him wealthy. So this condition is an affirmation of what is obligatory upon the seller.

The questioner : Yes.

The Shaykh : This is the correct opinion, and a hadith in the Sunan from Aisha (may Allah be pleased with her) indicates this:
That a man came to her from Sham, and she said to the Prophet (peace and blessings be upon him): "If you would send someone to so-and-so to buy two garments from him on credit until I am able to pay." أن رجلا قدِم له ... من الشام فقالت للنبي صلى الله عليه وسلم لو أرسلت أو بعثت إلى فلان فاشتريت منه ثوبين إلى ميسرة
The conclusion is that deferring payment with an unknown term is not permissible. However, deferring payment with what is the requirement of the contract, such as saying "until Allah makes me wealthy," is permissible. And Allah knows best.

The questioner : Yes.

The Shaykh : Yes.
