The questioner : Another question says: In Egypt, we have mosques that contain shrines. These places are full of innovations and evil deeds. They hold gatherings there and set up musical instruments and singing around them, along with some forms of deception such as sorcery, and various evil deeds are committed there. This is the case with the shrine of Sayyid al-Badawi in Tanta and others throughout the republic. However, they do not perform the prayer in them as it is due, or in its most complete and perfect form. Please inform us about this; may Allah reward you.

The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions. As for what follows, building mosques over graves is forbidden. The Prophet (peace and blessings be upon him) cursed the one who does it. He cursed this act while he was in the context of the hadith, (peace and blessings be upon him), where he said:
May Allah curse the Jews and Christians, for they took the graves of their Prophets as places of worship. لعنة الله على اليهود والنصارى اتخذوا قبور أنبيائهم مساجد
Sunan an-Nasa'i 703Sahih (Darussalam)
Therefore, building mosques over graves is the practice of the Jews and the Christians, and it is included in, indeed, it is among the causes of the curse of Allah (Blessed and Exalted is He).
If a mosque is built over a grave, it is obligatory to demolish this mosque, and the prayer in it is invalid. It is not permissible for a person to go there for worship or to believe that supplication is more likely to be answered there than in mosques that are free of graves. Likewise, it is not permissible to bury a dead person in a mosque that was built previously. If a dead person is buried in a mosque that was built previously, it is obligatory to dig him up and remove him, and bury him with the Muslims if he is a Muslim, or with the non-Muslims if he is a non-Muslim.
The important point is that it is not permissible to place a grave in a mosque, nor to build a mosque over a grave. It is also not permissible for a person to believe that these mosques built over graves are better than others; rather, they are invalid mosques according to the Shari'ah, and they must be demolished and eliminated. There is no difference between these mosques being built over those who are claimed to be awliya (close friends of Allah) or over ordinary people, for the ruling does not differ between the two. It is obligatory for Muslims in general to stand for Allah (Blessed and Exalted is He) with sincere religion for Him, following the Sunnah of His Messenger (peace and blessings be upon him), the Seal of the Prophets and the Imam of the righteous.
