A2 : First : Insulting the religion of Islam is a great apostasy from Islam if the one who insults it claims to be a Muslim. Whoever comes to know of this must forbid the evil and advise the one who did it, hoping that he will accept the advice, refrain from the evil, and repent to Allah (Glorified and Exalted is He). This is more emphasized in the case of a close relative, due to the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 49a . Second: It is not permissible to build mosques over graves, nor to bury the dead in them, nor is it permissible to pray in these mosques; due to the saying of the Prophet (peace and blessings be upon him): Sahih Muslim 532 narrated by Muslim in his Sahih. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

من رأى منكم منكرًا فليغيره بيده، فإن لم يستطع فبلسانه، فإن لم يستطع فبقلبه، وذلك أضعف الإِيمانBeware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.
ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد، فإني أنهاكم عن ذلك
