The Shaykh : We say to the brother questioner, al-Zahrani: It is obligatory for you not to swear except by Allah, because the Prophet (peace and blessings be upon him) said:
Whoever has to take an oath should swear by Allah or remain silent. من كان حالفاً فليحلف بالله أو ليصمت

Swearing by divorce or by the forbidden (haram) is not among the prescribed oaths. However, if it happens to a person, it is considered in the ruling of an oath, so he expiates for it with the expiation of an oath if he violates what he swore to. So this thing you mentioned: "I swear by the forbidden that I will not do it," and then you did it, it is obligatory for you to expiate with the expiation of an oath. That is by feeding ten poor people, or clothing them, or freeing a slave. If you do not find the means, then fast three consecutive days. But I advise you not to let your tongue slip in swearing by other than Allah, neither by the forbidden (haram) nor by divorce nor by anything else. Yes.
