The Shaykh : From his saying:
The lesser of the two, or the riba (usury or interest) أوكسهما أو الرّبا
, because it is known that a person will not choose the lesser amount unless the greater amount is prohibited; otherwise, he would not.
Second, it contains evidence for the prohibition of ruses (hila) and that they do not remove rulings. So, if one uses a ruse to drop an obligatory duty, the obligatory duty is not dropped. And if one uses a ruse to commit a forbidden act, the forbidden act is not made permissible.
An example of the first: if a person travels during Ramadan in order to break his fast. Traveling is a permission to break the fast, but if he travels in order to break his fast, he has used a ruse to drop an obligatory duty by doing something permissible. So, is this permissible act?
The student: Forbidden.

The Shaykh : Forbidden. And an example of the second, using a ruse to commit a forbidden act, is this hadith that is with us.
And it contains evidence that if a person deals in a transaction involving riba (usury or interest), it is obligatory for him to remove the riba (usury or interest), based on his saying:
He has the lesser of the two فله أوكسهما
. Because if he falls into riba (usury or interest), he falls into what is forbidden, so nothing remains but the lesser amount, and that is not realized except by removing the excess. This is supported by the saying of Allah the Exalted, O Ahmad:
But if you repent, you may have your principal - [thus] you do no wrong, nor are you wronged. فإن تبتم فلكم رؤوس أموالكم لا تظلمون ولا تظلمون
[Al-Baqarah 2:279]

The Shaykh : Ruses (hila), because ruses (hila) are a type of taking the verses of Allah in mockery. How does Allah prohibit this thing from you, and then you go and ... from another direction to reach it by the easiest means? So, the Shari'ah (Islamic sacred law) is a Shari'ah (Islamic sacred law) of seriousness and directness, not a Shari'ah (Islamic sacred law) of ruses (hila) and mockery.
