Question: Pledging productive wealth, such as date palms and grapevines, is a sale of the guarantee. Is the fruit permissible for the owner of the wealth or for the pledgee?
Answer: There is no harm in pledging productive wealth, such as date palms and grapevines. The fruit belongs to the owner, who is the pledgor. The pledgee may not take it unless he counts it toward the debt. As for taking the fruit while the debt remains as it is, that is forbidden riba (usury or interest). Likewise, if he pledges land, it is not permissible for the pledgee to take its rent unless he counts it toward the debt. It was reported from a group of the Companions of the Messenger of Allah (peace and blessings be upon him) that they warned against the creditor taking anything of value from the debtor in order to delay him or grant him time in the debt, and they considered that to be riba (usury or interest). However, if he gives him something extra at the time of repayment or after it, there is no harm; for the Prophet (peace and blessings be upon him) said:
for the best person is he who discharges his debt in the best mannerإن خيار الناس أحسنهم قضاء
