Question: From Abdulaziz ibn Abdullah ibn Baz to the honorable brother, the virtuous Shaykh, Judge of the Southern Circuit Court, may Allah grant him understanding in all good. Amen.
Peace be upon you, and the mercy of Allah and His blessings after it:
O Beloved, your noble letter number (262), dated 10/3/1390 AH, which is a response to my letter addressed to the virtuous Judge of Hijaz al-Qarn, number (2526/1), dated 12/12/1389 AH, has been received. May Allah guide you. I have reviewed the attached recording, which contains your confirmation of the nature of the divorce pronounced by the husband, H. M., on his wife. It states that a dispute arose between them, and he spoke to her, saying to her: “You are forbidden to me, and my soul has found peace in you.” He did not divorce her except with that statement. This was about three years ago. You verified this with the wife’s guardian, who is her full brother, after hearing the statements of the husband and the aforementioned brother, as well as the witnesses to the incident who corroborated their testimony.

Answer: Based on this, I issued a fatwa to the aforementioned husband that one divorce has taken effect on the aforementioned wife through the aforementioned statement. He may return to her through a new marriage with its valid conditions prescribed by the Shari'ah, as she has exited the waiting period. However, if the aforementioned husband intended by this statement to commit zihar and divorce her entirely, then he is liable for the expiation of zihar, and its implementation is not hidden from your virtue. This is in addition to the aforementioned divorce, which is indicated by his statement, “my soul has found peace in you.” I ask you to question him and verify his intention, then inform him and the guardian of the aforementioned fatwa. May Allah reward your efforts and bless your endeavors, and may He reward you with good for all of this. Peace be upon you, and the mercy of Allah and His blessings.
