Ruling on one who divorces his wife with three divorces and makes her forbidden to him like his mother
Machine translationRead the Arabic original
Question: From Abdulaziz ibn Abdullah ibn Baz to the honorable brother, the virtuous Shaykh, the Judge of al-Na'iriyah, may Allah guide him to all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved, I have reviewed the attached document sent to me by you with number (401) and date 16/10/1398 AH, in response to what I wrote to you with number (1450/1/Kh) and date 2/10/1398 AH, and I have understood what is in it. The summary is: that the husband M. R. divorced his wife with three divorces in a single word, and made her forbidden to him like his mother, and this was before he consummated the marriage with her?
Answer: I inform you that based on this, I issued a fatwa to the aforementioned husband that one divorce has taken effect on the aforementioned wife due to the divorce mentioned, and he may return to her with a new marriage contract with its valid conditions according to the Shari'ah, and he must pay the expiation for zihar before he touches her, as the scriptural evidence indicates this, as is well known. I hope you will inform everyone of the aforementioned fatwa, and order the husband to repent from his divorce with three divorces, as it is a reprehensible divorce, as your virtue knows, and make him understand the Sunnah divorce so that he is clear about the matter in the future. May Allah reward you and thank you for your efforts.
And peace be upon you and the mercy of Allah and His blessings.
