Question: I bought a car and sold it on installment. It is known that the installment price is higher than the cash price; for example, I might buy a car for 50,000 riyals in cash and sell it on installment over a long period, such as three years, for 80,000 riyals. The car owner who buys it from me, in turn, either sells it or uses it for himself. What is the ruling on this?

Answer: There is no harm in this sale, provided that the car was in the possession and ownership of the seller when he sold it on installments, and the installments had a known term; because this transaction and its like fall under the saying of Allah the Exalted:
O you who have believed, when you contract a debt for a specified term, write it down.يَا أَيُّهَا الَّذِينَ آمَنُواْ إِذَا تَدَايَنتُم بِدَيْنٍ إِلَى أَجَلٍ مُّسَمًّى فَاكْتُبُوهُ
[Al-Baqarah 2:282]
the verse [al-Baqarah:282], and His saying (peace and blessings be upon him) :
But Allah has permitted trade and has forbidden interestوَأَحَلَّ اللّهُ الْبَيْعَ وَحَرَّمَ الرِّبَا
[al-Baqarah:275].
It is established in the two Sahihs from Aisha (may Allah be pleased with her) that a slave girl named Barira was manumitted by her people in exchange for nine installments, one installment per year, each being forty dirhams. The evidence for this is abundant.
As for the buyer on installment, he may use the car and he may sell it, but he is not permitted to sell it to the person who bought it from him for less than the cash price he paid for it; because this transaction is the forbidden 'inah, and success is from Allah.
