The ruling on one who swore by divorce to attend an appointment and was late
Machine translationRead the Arabic original
Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz, to the honorable brother / W. M. A, may Allah guide him to all good, amen.
Peace be upon you, and the mercy of Allah and His blessings. After that:
Your letter dated 16/1/1393 AH has been received, may Allah guide you. It contained the information that you swore by divorce to attend a specific person at a set time, but you did not attend until two hours after the time you had set for your arrival. Your desire for a fatwa was known.
And the answer: If your intention in doing so was to urge yourself to attend at the set time and not to be late, and you did not intend to separate from your wife if you were late, then the divorce mentioned did not take place. You owe an expiation for an oath, which is: feeding ten poor people, giving each poor person half a sa' (a dry measure of about 3 kg) of the staple food of the country, such as dates, rice, wheat, or other such food.
However, if your intention was otherwise, or if there is a dispute between you and the woman's family, you should attend with her guardian (wali) before the honorable judge in your area, to seek his ruling on what he deems appropriate, or to establish the nature of the situation and provide information about it. I will look into that, if Allah wills. May Allah guide everyone to what pleases Him.
And peace be upon you and the mercy of Allah and His blessings.
