O Beloved: Your noble letter dated 16/5/1390 AH has reached you, may Allah guide you, and I have reviewed the attached memorandum, which contains your confirmation of the nature of the divorce pronounced by the husband, 'A. Sh., upon his wife.
Namely, that he became angry with the aforementioned wife, so he went to a person and asked him to write her divorce, and he uttered before him the words: "Write her divorce as three, so that she becomes forbidden to me and permissible to others," in a single utterance without repeating it. It is also stated that he had not divorced her before this occasion, and in response to his brother, he stated that he asked his sister, and she told him that he did not divorce her in her presence, and that he heard from people about his divorce recorded on the paper, and that they believe what he said, and that his sister wishes to return to her husband whenever a fatwa to that effect is obtained.
I have reviewed the attached divorce paper and found it dated 2/5/1390 AH.
Answer: Based on all of this, I have issued a fatwa to the aforementioned husband that one divorce has taken effect on the aforementioned wife through the divorce mentioned, and he may take her back as long as she is in the waiting period. If she has exited the waiting period, she is not permissible to him except through a new marriage, with its conditions considered valid by the Shari'ah, as is clear. It is authentically reported from the Prophet (peace and blessings be upon him) what indicates the aforementioned fatwa, as your eminence knows.
I hope you will inform everyone of this—may Allah reward you, thank you for your efforts, and reward you with good for everyone—just as I hope you will alert the husband that pronouncing three divorces is not permissible, and that he must repent from that.
