Question: From Abdul Aziz ibn Abdullah ibn Baz, to the honorable brother, the virtuous Shaykh, the judge of Baljurashi, may Allah grant him understanding, amen.
Peace be upon you, and the mercy of Allah and His blessings. After that:
O Beloved: Your noble letter, number 999, dated 1/8/1392 AH, has arrived, may Allah guide you. I have reviewed the attached recording, which contains the statement of the confession of the wife, S. A. Q., and her brother, that they do not know that any divorce occurred from the aforementioned husband to the aforementioned wife, other than what he confessed to, which is that he divorced her with a final divorce using this phrase, and that he did not divorce her before or after that. They expressed their desire to return to him if the Shari'ah permits it.
Answer: Based on this, I have issued a ruling to the aforementioned husband: that one divorce has occurred with his aforementioned wife through this divorce. He may take her back as long as she is in the waiting period. If she has exited the waiting period, she is not lawful for him except through a new marriage, with its conditions that are considered valid in the Shari'ah; because it is authentically reported from the Prophet (peace and blessings be upon him) what indicates this, as is not hidden. I hope you will inform everyone of this. May Allah reward you and keep your steps steady.
