The questioner: I have a loan that exists. We are living in Kuwait, and I am in Europe. So I have a loan, and the bank where I have a safe deposit box was stolen from. I put a sum of money and gold in it.

The Shaykh : Who put it in?

The questioner: My sister.

The Shaykh: All right.

The questioner: So I called her. Among the gold she put in, I had bought some gold. I bought it and put my name on the invoices. I bought it for her from Oman to Kuwait.

The Shaykh: All right.

The questioner: So I bought it, meaning there is no difference, meaning no one thought of anything. So the bank was stolen from, and this safe deposit box belonging to people was stolen. The bank asked them to return the money so that it is proven what is with her. Since we are in Europe, it is forbidden for one to hoard a large amount, because as soon as they ask her, "Where did you get this?"

The questioner: So I called her and she said, "Can I put my name on the invoices that were stolen?" I did not know how to say it, so I told her to put it. She went back to the bank insurance officer. The bank returned the money. It returned her fifty percent. It returned her twenty percent, and I, since the invoices I bought for her were three thousand dinars, thirty were returned to me. So here the money came in my name, but it is my husband's bank. She called and said, "The money arrived, but it is in your husband's bank. Can you tell your husband to tell his brothers to send it to me? Meaning, your husband calls his brother and tells him to give her the money."

The questioner: My husband tells me, "I have confirmed to you that this money is not extra for her, but he is coming to her with a lot. She is telling me, 'I have invoices that I did not take the full amount, and I have stopped a lawyer and I want the full amount.'"

The Shaykh : Yes.

The questioner: So I, just so they do not ask me where this is from and where that is from, and so they do not make a violation against me, put my name on it.

The Shaykh : Yes.

The questioner: So my husband tells me, "This is forbidden money."

The Shaykh : Your husband tells you the money is forbidden, why?

The questioner: I am the one who wants it. He told me the best thing is to call our shaykh, Muhammad, and he will resolve it for us. He will see how this is?

The Shaykh : Excuse me, but I want to understand. When your husband tells you this money is forbidden, what is his point?

The questioner: The money would be extra.

The Shaykh : Okay, are you sure about your sister or not?

The questioner: By Allah, honestly I am sure, because I bought the gold for her, and no one knows her situation except me.

The Shaykh : If you are taking riba on her money, and only taking, as you said, less than what is hers.

The questioner: She took less than what is hers, and because she does not want riba, she does not put it in the bank, she puts it in a safe deposit box.

The Shaykh : There is no power nor strength except by Allah. I understand, I understand. May Allah guide you. I am saying, listen to the answer only.

The Shaykh : I am saying and repeating what I said: If you are sure of your sister's religion, her truthfulness, and her trustworthiness, and that she is truthful when she says, "In your name, I will recover less than what is in the box," if you are sure of her words, then there is nothing on you and nothing on her.

The questioner: She has the right, he gives her the money.
