The Shaykh : The greatest scholar in the world, from the Salaf (the earliest generations) and the Khalaf (the later generations), is he able to say in every issue, whatever its type, especially in practical rulings, that he can bring an explicit text from the Book and the Sunnah that details the specific issue being asked about? Or is independent legal reasoning (ijtihad) necessary?
The student : It is necessary.

The Shaykh : Now, if this layperson is forbidden from taqlid (following a scholar without knowing his evidence), and he comes to the scholar and asks in a partisan manner: What is Allah's ruling on smoking?
The student: Yes.

The Shaykh : He will not be able to tell him, "Allah said so and so, as the Messenger of Allah (peace and blessings be upon him) said regarding intoxicants:
Every intoxicant is Khamr (wine) and every Khamr is unlawful. كلُّ مسكرٍ خمرٌ ، وكلُّ خمرٍ حرامٌ

." Instead, he will say, "By Allah, it has become clear to me," and he will give a lecture, just as I do, about smoking, bringing arguments from here and there and here, and then he will say, "Smoking is forbidden." If you go back and ask this person, "What is the ruling on smoking?" he will tell you, "It is forbidden." If you ask him in a partisan manner, "What is the evidence?" he will tell you, "By Allah, the Shaykh said so," because he is unable to repeat the lecture the Shaykh gave. So what do we say about this person? This person must have people around him; perhaps the man is married, has a wife, and has children. What is he going to tell them? Is smoking forbidden or permissible? He will tell them, "It is forbidden." Now, he does not have the evidence; his evidence is his mufti (a scholar who issues fatwas) and his scholar.
