The Shaykh :"And if you find the permissible item defective, you are given the choice between its compensation and its value" If you find the permissible item defective—by "permissible" I mean you gave her something permissible as a gift and found it defective—she has the option. If she wishes, she takes the compensation (arsh); if she wishes, she takes the value. For example, you give her your car, stating that it has no defects, but when she takes it, she finds it is defective. What does she do? We say to you now: you have the option. If you wish, take the compensation; if you wish, return it and take the value. What is the compensation? The compensation is the difference between its value when sound and its value when defective. If they say this car is worth eight thousand when defective and ten thousand when sound, what is the compensation? The compensation is two thousand. If she wishes, she takes two thousand and keeps the car. If she wishes, she returns the car and takes the value. What is the value? Ten thousand. Is this clear? This is the meaning of the author's statement.
