Peace be upon you, and Allah’s mercy and blessings, and after that:
I refer to your inquiry, registered with the Department of Scholarly Research and Ifta under number 2151 and dated 6/6/1407 AH, in which you ask about the ruling on one who resorts to those who judge by man-made laws, if all the courts in his country judge by man-made laws and he cannot obtain his right except by resorting to them. Does he become a disbeliever?
Answer:
I inform you that if he is compelled to do so, he does not become a disbeliever. However, he has no right to resort to them except in cases of dire necessity, if he cannot obtain his right except through them. And he has no right to take anything other than what the pure Shari'ah permits.
