Explanation of Riyad al-Salihin-83a

Machine translationRead the Arabic original
The reciter: Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions.
He (may Allah have mercy on him) said: "Chapter on the prohibition of insulting the dead without right or legitimate religious interest. 'Aishah (may Allah be pleased with her) said: The Messenger of Allah (peace and blessings be upon him) said:
Do not verbally abuse the dead, for they have reached the consequences of what they did. لا تسبوا الأموات فإنهم قد أفضوا إلى ما قدموا
Sunan an-Nasa'i 1936Sahih (Darussalam)
Narrated by al-Bukhari
"

The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful.
The author (may Allah have mercy on him) said in his book Riyad al-Salihin: "Chapter on the prohibition of insulting the dead without right or legitimate religious interest." By "the dead," he means the dead among the Muslims. As for the disbeliever, he has no sanctity, except if insulting him causes harm to his living relatives; in that case, he should not be insulted. But if there is no harm, he has no sanctity. This is the meaning of the author's (may Allah have mercy on him) phrase "without right," because we have the right to insult the dead disbelievers who harmed the Muslims, fought them, and tried to corrupt their religion. Or for a legitimate religious interest, such as if the deceased was a person of religious innovation who spread it among the people. In this case, it is in the public interest to insult him and warn people against him and his method, so that people are not deceived by him.
Then he cited as evidence for this the hadith of 'Aishah (may Allah be pleased with her), in which the Prophet (peace and blessings be upon him and his family) said:
Do not revile the dead لا تسبوا الأموات
The original ruling regarding prohibition is that it is forbidden, so do not insult the dead. Then he gave the reason, saying:
For they have reached what they sent ahead فإنهم أفضوا إلى ما قدموا
Sahih Ibn Hibban 11:132
His personal resurrection has occurred, his deeds have been cut off, and he has no share in any deed whatsoever, except what the Sunnah indicates, such as his saying (peace and blessings be upon him and his family):
When a man dies, his deeds come to an end, except for three: A continuous charity, knowledge by which people derive benefit, pious son who prays for him. إذا مات الإنسان انقطع عمله إلا من ثلاث صدقة جارية أو علم ينتفع به أو ولد صالح يدعو له
Riyad as-Salihin 949

In this is evidence that it is recommended for a person to guard his tongue from what has no benefit, for this is the path of the people of taqwa (mindfulness of Allah). When the slaves of Allah pass by idle talk, they pass by with dignity. And as for falsehood, they do not witness it at all, and they do not speak except with truth. And success is from Allah.
