Demolishing a grave to re-dig and rebuild it
Machine translationRead the Arabic original
Q: A grave has collapsed, and I want to re-dig and rebuild it, but there are bones in it. What should I do with them? And is it permissible to build the grave with gravel and cement, or with bricks and cement?
A: If a grave collapses, the earth is returned to it, and its surface is leveled like the other graves so that it is not desecrated. As for building it or plastering it, that is not permissible; because of what is established from the Prophet (peace and blessings be upon him) in the hadith of Jabir ibn Abdullah al-Ansari (may Allah be pleased with them both), who said:Sahih Muslim 970a It was narrated by Muslim in his Sahih. And because plastering it and building upon it are among the causes of exaggeration in it and calling upon it instead of Allah. This has happened to many people when their graves were made grand and domes and mosques were built over them; people took them as lords besides Allah, by calling upon them, seeking aid from them, seeking blessing from them, and asking for support from them, as many people do at the grave of al-Husayn and the grave of al-Badawi and others. For this reason, it is established from the Messenger of Allah (peace and blessings be upon him) that he said: It is agreed upon that it is authentic. Also, in the two Sahihs, it is narrated from Umm Salama and Umm Habiba (may Allah be pleased with them both) that they mentioned to the Prophet (peace and blessings be upon him) a church they had seen in the land of Abyssinia and the images in it, and he said (peace and blessings be upon him): Sahih al-Bukhari 434 And in the Sahih of Muslim, it is narrated from Jundub ibn Abdullah al-Bajali (may Allah have mercy on him) from the Prophet (peace and blessings be upon him) that he said: Sahih Muslim 532 And there are many hadiths in this meaning.
Therefore, it is obligatory for all Muslims, from governments and peoples, to fear Allah (Glorified and Exalted is He), and to beware of exaggeration in graves, building upon them, and making mosques over them, in accordance with the prohibition of the Prophet (peace and blessings be upon him) and obedience to him, and out of fear of the consequences of that. For that is a means to exaggeration in the dead, calling upon them, seeking aid from them, and asking them for support and help. And this is major shirk (associating partners with Allah), which the disbelievers of Quraysh and others from the Arabs and non-Arabs used to do, until Allah removed that from this peninsula by the call of the Prophet (peace and blessings be upon him), his jihad, the jihad of his Companions (may Allah be pleased with them), and the jihad of those who followed them with goodness from the imams of guidance and callers to tawhid (the oneness of Allah). May Allah make us among them. And success is from Allah.

نهى رسول الله ﷺ أن يجصص القبر وأن يقعد عليه وأن يبنى عليهMay Allah curse the Jews and the Christians who took the graves of their prophets as mosques.
لعن الله اليهود والنصاوى اتخذوا قبور أنبيائهم مساجدIf any righteous pious man dies amongst them, they would build a place of worship at his grave and make these pictures in it; they are the worst creatures in the sight of Allah.
أولئك إذا مات منهم الرجل الصالح بنوا على قبره مسجدًا وصوروا فيه تلك الصور، أولئك شرار الخلق عند اللهfor Allah has taken me as His friend, as he took Ibrahim as His friend. Had I taken any one of my Ummah as a friend, I would have taken Abu Bakr as a friend. Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.
